1. Scope and contracting party

These terms apply to all contracts for goods from the MyPatio.eu range. Your contracting party is SIA “Montrex”, Lapsu iela 6, LV-1035 Riga, Latvia (reg. no. 50103408991, VAT no. LV50103408991), hereinafter “we”.

2. Inquiry, offer and conclusion of contract

The presentation of products on this website is not a binding offer. Using the inquiry list, you send us a non-binding inquiry. We reply by email with a binding offer including the final price, shipping costs and expected delivery date. The contract is concluded when you accept this offer by email. You will receive the contract text and these terms with our order confirmation by email.

3. Prices and payment

All prices on the website are final prices in euros including statutory VAT, plus shipping costs. Shipping costs depend on the delivery country, weight and type of delivery and are stated in the offer before the contract is concluded. The price in the offer is decisive. For business customers (entrepreneurs) with a valid VAT identification number, deliveries throughout Europe are invoiced without VAT; within the EU the reverse-charge procedure applies. Unless agreed otherwise, payment is made in advance (bank transfer) after receipt of the order confirmation. Please state the order number with your transfer.

4. Delivery

We deliver to the countries listed on the website. Smokers are usually delivered fully assembled; delivery on a pallet is available for a surcharge. The delivery time is stated in the offer. If an item is not in stock after payment, we will inform you by email without delay and give a new delivery date; you may then withdraw from the contract and we will refund any payments immediately. For deliveries to countries outside the EU (e.g. Switzerland, Norway), customs duties and import charges may apply and are borne by the buyer.

5. Retention of title

The goods remain our property until paid in full.

6. Statutory warranty

The statutory warranty rights apply. The warranty period is at least 24 months from delivery; if the law of the country in which you as a consumer have your habitual residence provides for a longer period (e.g. Sweden, Norway), that period applies. Please report defects to info@mypatio.eu. Natural wear from intended use (e.g. patina, heat discolouration of paint and steel) and damage caused by improper assembly, operation or modification do not constitute a defect. Please observe the enclosed instructions for use and safety.

7. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under product liability law. For slightly negligent breach of essential contractual obligations, liability is limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded.

8. Force majeure

Events of force majeure (e.g. natural disasters, war, official orders, strikes) that make delivery substantially more difficult or impossible release us from our obligation to perform for their duration. We will inform you without delay in such a case.

9. Right of withdrawal

Consumers have a statutory right of withdrawal. Details are set out in the withdrawal policy.

10. Dispute resolution and final provisions

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. The law of the Republic of Latvia applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected. If the customer is a trader, the place of jurisdiction is Riga. Should individual provisions be invalid, the remainder of the contract remains valid.
